Essay Letter to Dean Robert D’Agostino – My Post-Law School Intellectual Mentor, Confidant and Friend for 30 Years (1995-2025)

Prologue—In Memoriam of John Marshall Law School Dean David Meltz (d. March 18, 2018), my Dean and Constitutional Law Professor before I knew Dean Robert D’Agostino

I feel compelled to offer this abridged mention of a colleague of Dean D’Agostino and myself, former Dean Emeritus and Professor Dr. David Meltz. This Jewish intellectual was everything to me. I mentioned his contributions to my intellectual development along with other scholars (including Dean Robert D’Agostino) in footnote 2 of my 2-part essay series celebrating the 50th anniversary of the landmark SCOTUS desegregation decision, Ellis Washington, A Voice Crying Out in the Wilderness: A Word about Brown vs. Board of Education,” Valparaiso University Law Review, Vol. 39, No. 1 [2004], Art. 4, Note 2.

In the summer of 1992 as I was completing my first year of law school at Thomas Cooley Law School (Lansing, Mich.) it was Dean Meltz who was the only person on the planet to help me after failure to get accepted into law school at the University of Michigan (where I had a graduate degree in Music Performance [12/1987] and was perhaps the first Black Editor of the Michigan Law Review [May-Aug. 1989]).

Ironically failed to gain admittance to Harvard Law School (where I was a working on a graduate degree in History [1988-89]). I attended Thomas Cooley Law School (1991-92) as a fail-safe choice and was doing poorly when applying to other law schools. I soon obtained a personal call from Dean David Meltz of John Marshall Law School in Atlanta who seemed to be elated that a student of my background was interested in attending John Marshall Law School. I was taken aback and didn’t really know what to say, but “yes” to his offer to start JMLS in Aug. 1992. The rest (as they say) was history.

Speaking of History, National Review writer Jay Nordlinger in 2018 wrote something I find rather profound regarding one of my favorite writers and thinkers of all time, Alexander Solzhenitsyn (1918-2008) whose son (Ignat) gave this aphorism regarding the motivation and singular dedication to his  writing craft of his famous father for the Ages…

As Ignat Solzhenitsyn once put it to me, “He could have written The Red Wheel [the multi-volume project that consumed the author’s exile] or he could have dealt with his critics. He did not have time to do both.” He chose The Red Wheel.

However, aside from my law school education what really gave me a transcendent experience by knowing Dean David Meltz was that he always treated me not like a student, but as a colleague, even a friend. One memory I will never forget was in my Jurisprudence class (that along with Dean Meltz Constitutional Law) was my favorite classes! We were presenting our case briefs and reviews of landmark Supreme Court Cases to the class. 

That day was my day and I was to present Griswold v. Connecticut, 371 U.S. 479 (1965)— The landmark U.S. Supreme Court case in 1965, Griswold v. Connecticut, which ruled that the Constitution protects a married couple’s right to privacy and to use contraceptives. About a minute before I was to present my case, Dean Meltz slipped into the classroom and sat right in front. It threw me off, but I soldiered onward. I later deduced that he and my Jurisprudence professor had discussed my intellectual development in this class throughout the semester and that Dean Meltz wanted a front row seat to personally review my case brief presentation which went very well. I was very moved that Dean Meltz thought so much of me as to personally give me this honour.

Nevertheless, just 9 years later in 2003 the 6-time Most Outstanding Faculty Member was essentially forced to resign for showing deference to one of his law students regarding taking a final exam, thus proving the famous aphorism by that iconic Austro-Bohemian-Jewish classical composer and conductor, Gustav Mahler (1860-1911) to be most tragically prescient and ironically true

*N.B.: Interlude—Gustav Mahler (1860-1911) was one of the best composers of the Late Romantic, early Modern era and the greatest conductor of his era. Mahler wrote 9 symphonies and several tone poems. Listen to an excerpt from his transcendent Symphony No. 2 {Auferstehung – “Resurrection”), the brass chorale section. 

Also, It was Dean Meltz that saw the fire of learning burning deep in my soul and invited me to take a directed study with him on Constitutional Law where I wrote an amicus curiae brief on (I believe) the unconstitutional separation of Church and State. A subject that I later compiled into a book, titled—The Inseparability of Law and Morality (2002), which was inspired by

Chief Judge Richard A. Posner’s famous 1997 Harvard Law Review article celebrating the 100th anniversary of Justice Oliver Wendell Holmes’s iconic Harvard Law Review article expounding Holmes’s ideas on Legal Realism which was his famous law as prediction theory in, The Path of Law (1897). Also this 2002 opus was immediately accepted into the Royal Archives of HRH Queen Elizabeth II (1952-2022).

 

 

 

Dean Meltz also would frequently invite me to his office often to loan me books from his vast library of writers I had never read before, but now 30 years later, I have written about many of these intellectual legends and published scholarly works on the oeuvre thanks to Dean Meltz. Here is just a small sample of writers and intellectuals Dean Meltz insisted I read, but this list is not complete—

Regarding this last book by Ayn Rand, my son Stone studied her writings in high school (2014-15) and I encouraged him to do his project on one of Rand’s books. Stone chose Ayn Rand’s dystopian novel, Anthem, for his AP Literature final project at Grosse Pointe High School (2014).

I suggested to my son that he set the mood to his presentation of Ayn Rand’s novel, Anthem based on one my favorite episodes of the Twilight Zone, “The Obsolete Man” (1961)(Ep. 65), starring Burgess Meredith as Romney Wordsworth, the accused, and Fritz Weaver as the Chancellor (and prosecutor).

Essay Letter to my Intellectual Mentor & Friend Dean Robert D’Agostino (aka “Dean Dag”)

Greetings Dean Robert D’Agostino:

It was very nice to have lunch with you last Wednesday at Sunrise at Huntcliff Summit. It was a very nice meal, and the facilities there are first class all the way. I look forward to having lunch with you again soon and I’m also looking forward to visiting with your political discussion group when they meet on Fridays @2:00.

Dean Dag, kindly give my regards to your son and congratulations on obtaining his new law professor position.

Career Highlights: Professor Robert D’Agostino practiced bankruptcy and commercial law for 20 years between careers in academia. Prior to joining John Marshall in 1995 and after practicing law for some 15 years, Professor D’Agostino was a tenured professor at what is now Widener Law School in Delaware. In 1981–1982, he took a two-year leave of absence from Widener to serve as a presidential appointee to the U.S. Department of Justice under President Ronald Reagan, where he served as an Assistant Deputy Attorney General for Civil Rights. Professor D’Agostino also served as Dean from 1996 to 2000. His publications deal with topics related to bankruptcy, civil rights, and constitutional law. An avid bicyclist, “Dag” is also a political activist.

Over the course of his career, D’Agostino has also participated in several U.S. Supreme Court amicus briefs dealing with bankruptcy issues. v Robert D’Agostino: A Conservative at Columbia University—Ground Zero for Propagating Critical Theory and Cultural Marxism the Precursors of Students for a Democratic Society (1960) who infamously stated – The issue of never the issue. The issue is always the [Communist] Revolution;  ANTIFA (1930s), Affirmative Action (1961), Black Lives Matter (2013), Diversity, Equity and Inclusion [DEI] (1865)

 

 Dean Dag, I noticed from reading your biography that you attended Columbia University where you received your bachelor’s and master’s degrees. Since we now understand that Columbia University (even above Harvard, Yale, Cornell, University of Michigan, and the University of California—Berkeley), was considered Ground Zero for bringing Cultural Marxism to America via its colleges and universities, which eventually leached this intellectual perversion and rot into society and culture. This begs the question, Dean Dag did you study with any of these first or second or third generation of Cultural Marxist Professors teaching “Critical Theory” and “Cultural Marxism while at Columbia? Professors like – Max Horkheimer, Theodore Adorno, Herbert Marcuse, Jurgen Habermas and others? If so, what did you think about these men from an intellectual, cultural and political perspective?

P.S.: Exceeding gratitude to you Dean Dag for your solicitude in working behind the scenes 30 years ago after I graduated from JMLS to get me on the law faculty there, however a lady overseeing the Bar procedures for JMLS at that time dissembled against my application and said that the Bar would look down on JMLS if they hired their own graduates. That was a lie that killed my law faculty dreams in the cradle.

As a human being I am exceedingly disappointed that others unjustly killed my law faculty dreams through deceit, lies and intellectual discrimination against scholars possessing a Conservative or Christian worldview, nevertheless, like my intellectual mentor, the Holocaust survivor and iconic writer, Elie Wiesel (1928-2016), who taught me —‘Because I REMEMBER, I despair. Dean DAG, I don’t remember if I told you this history about myself but while I was a graduate student at Harvard studying History (1988-89), I took my first law classes at Harvard Law School (Jan. 1989) at the same time attending HLS with future POTUS Barack Hussein Obama. One of my professors was the famous Civil Rights Scholar, Randall Kennedy. Two other scholars I studied with in a de facto way were Alan Dershowitz and Laurence Tribe. 

All 3 people graduated from Harvard Law School and taught at Harvard Law School for decades without a peep of disagreement from the so-called B.A.R. It’s high time for President Trump to purge this ancient vestige of British imperialism [e.g., B.A.R. = British Accreditation Registry] completely from having any informal or formal power inside our American legal system
