An American Judicial Judas: 1994-2024—30th Anniversary of Exposing Chief Judge Richard A. Posner’s Legacy = Betrayed President Reagan, Betrayed the Judiciary, Betrayed America—Part II

*N.B.: 15 months before abruptly resigning from the bench with ONE DAY’S NOTICE! on 1 Sept. 2017 after 36 years due allegedly to as the propaganda media dissembles that Judge Posner was increasingly fighting against his colleagues on the court allegedly because of the unfair way they treated Pro se [indigent, e.g., majority Black] plaintiffs and defendants which makes absolutely no sense to me.

Why? Because I reviewed all Pro Se appeals when I briefly worked as a Deputy Law Clerk in Chief Posner’s court (May-June 1996). There were many of them sent to our office and most were sent back because they didn’t follow Court Rules. Why didn’t Chief Judge Posner substantively help these majority Black people get Justice THEN? Because Judge Posner never cared for Pro See Plaintiffs or Pro Se Defendants, he never cared about Black People, neither did he ever care about a ‘Pro Se Protegee’ like me who in love of the Constitution and love of America, and love of Chief Judge Richard A. POSNER, I reached out to him to befriend him, to counsel him for 30 YEARS!… all in vain.

In reality, I believe Posner was forced to ‘retire’ from the bench due to an embarrassing and very public fraud scandal paradoxically regarding Posner’s Pro Se Center (ironically created by Judge Posner during the twilight of his judicial career allegedly to help Pro se indigent largely Black plaintiffs and defendants). Also I believe Posner’s abrupt retirement had something to do with his ever-worsening Alzheimer and dementia diagnosis that he could no longer hide from his bosses… We the People!

And over the past 30 years of my interaction with this scholar including sending numerous Book Notices, Books, Law Review articles, Open Letters, Essay Letters and other writings sent to the entire Law Faculty at the University of Chicago Law School… all to no avail! Naive though I may have been over the past 30 years since I first discovered Judge Posner’s writings during my senior year in 1994, I still like to fanaticize that perhaps my legal and academic career would have been different if me and the Good Judge met in person… However, I understand that Judge Posner met Justices Thomas and Antonin Scalia in person and (because of their Textualism and Originalism jurisprudence) did NOT like them at all, therefore I have no regrets not meeting Judge Posner personally. I believe that despite not being welcomed into the Law Academy as an intellectual equal over the past 30 years that things ultimately worked out in my life as they were supposed to be in order to bring God the most Glory. #SoliDeoGloria.

My original intent was to have this opus (“REPLY TO JUDGE POSNER…”) published in the elite HARVARD LAW REVIEW because about 6 or 7 other legal scholars had done an individual ‘Reply’ in the same HLR volume as Chief Judge Posner, so and I wanted to be part of that intellectual genealogy including—

UChicago Philosophy Professor, MARTHA NUSSBAUM. (See, “Still Worthy of Praise” [a Reply to Richard Posner’s Holmes Lectures], Harvard Law Review 111, 1776-95, 1998) & Judge and Prof. CHARLES FRIED (1935-2024), a Harvard Professor & former Federal Judge and Solicitor General (under President Reagan)

who called Posner’s  arguments “too gross and unnuanced” to refute, among several other academics had published in #HarvardLawReview their own  pre-written[?] individual “Reply” to Judge Posner’s iconic Law Review Article that inspired my opus titled—”THE PROBLEMATICS OF MORAL AND LEGAL THEORY” (HLR: 1997).

celebrating the 100th anniversary of Justice Oliver Wendell Holmes’s iconic and in my opinion, infamous 1897 article, THE PATH OF LAW – a radical and controversial opus which in essence launched the Progressive Revolution movement in Jurisprudence, and Legal Theory called ‘Legal Realism’ (e.g., separating ‘Legality’ from ‘Morality’) and what later became associated with Judge Posner what legal philosopher and public intellectual, Professor Stanley Fish speaking of the writings of Richard Rorty and Richard Posner called “almost Pragmatism” in American Constitutional Law.

   

However, since the editors of the Harvard Law Review rejected my Judge Posner manuscript, I submitted it to many other law reviews for publication consideration including Rutgers who gladly accepted it as their Lead Article of Vol. 3—See, Ellis Washington, Reply to Judge Richard A. My first law review article was so well received by the Law Academy and the General Public that I decided to make it the concluding 3 chapters (or Epilogue) of my 3rd book, “THE INSEPERABILITY OF LAW AND MORALITY” (2002), a unique opus from my oeuvre which has these 2 singular Honours:

(1)   My 3rd book (containing my “Reply to Judge Posner” as the book’s Epilogue) was accepted into THE ROYAL ARCHIVES of HRH QUEEN ELIZABETH II (Queen of England: 1953-2023) in 2002; (2)   Associate Justice CLARENCE THOMAS, my friend and intellectual mentor since Jan. 1989 [for 35 YEARS] and my son, Stone Washington‘s mentor since 2015, personally approved the acceptance of this opus into the CHAMBERS LIBRARY of SCOTUS in 2002.

Epilogue—Why do I believe that after 30 years of critically examining and exposing Judge Richard Posner’s Prolific but CIA-MKUltra Mind Controlled and Machiavellian writings that his Legacy of Infamy comes down to 3 simple Statements = Betrayal of President Ronald Reagan, Betrayal of the Judiciary, Betrayal of America?

 

Judge Posner entire oeuvre is a combination of Deception – Betrayal of President Ronald Reagan who thought (as a politician) that he was appointing a staunched Originalist, Natural Law, Natural Rights, Conservative Republican to the Federal Bench when he was advised by treasonous advisors to nominate Posner on 27 October 1981. However, in reality, Posner’s entire judicial career was a bastardization of the Constitution (thus the “B-” in the essay’s meme at the beginning in my opinion should have been an “F” for Fascism) and deconstruction of legitimate Constitutional Law, the Rule of Law, sound constitutional jurisprudence. Tragically, Judge Posner spent the past nearly 55 years as a Hidden Ivy-League Senior Lecturer and academic and 36 years as an Appellate judge while gleefully deconstructing and destroying without fear of retribution for Defrauding the U.S., Judicial Malfeasance, Misprison of Treason, Rebellion and Insurrection, Treason and Sedition charges, etc…

 

Second, Judge Posner betrayed the Judiciary which is the office President Reagan entrusted him to spend his entire judicial appointment to protect and to defend the U.S. Constitution and to uphold the Rule of Law. Posner’s failure as a law-abiding Judge and to do so on the federal bench for 36 years from 1981-2017 caused incalculable damage to not only his Seventh Circuit Court of Appeals, the Supreme Court of which he was unofficially called “the Tenth Justice”, but Chief Judge Richard Posner as a very prolific jurist, legal scholar and “One of the World’s Leading Public Intellectuals”

 

intrinsically and extrinsically corrupted the entire judiciary because he placed his own ‘Personal Policy Preferences’ ABOVE and BEYOND the blackletter of the U.S. Constitution (e.g., Textualism) and the Biblical mandatesenshrined in the Bill of Rights based on Natural Law and Natural Rights (e.g., Originalism). This Judas-level treachery by Judge Posner cannot be ignored by the Academy nor forgiven by me, the Judiciary, or by We the People. Thus, these numerous ‘High crimes and misdemeanors’ and Conspiracy to Commit Fraud on the United States in my opinion makes Judge Richard Posner worthy of a military tribunal for Crimes Against Humanity.

 

In fact, Judge Posner seems to have abruptly left the bench after 36 years with one day’s notice on 1 Sept. 2017 (ironically during President Trump’s first term as POTUS) because as his Wikipedia article sadly states which at the time of this writing, Judge Posner was accused of defrauding one of his employee’s, Brian Vukadinovich, director of his “Posner Center for Pro Se’s [now permanently closed] out of $170,000.00 in back wages while after a protracted legal and mediation proceedings settled on $120,000, Judge Posner ultimately only paid the plaintiff $8,000. Furthermore, I believe that like Resident Joe Biden, that Judge Posner’s mental breakdown existed many years earlier before his Feb. 2018 diagnosis, a sham defense of ‘lack of capacity’ which his ironically used to defraud Vukadinovich claiming Posner lacked capacity to contract at the time due to his dementia diagnosis in Feb. 2018.

 

Why do I believe that Judge Posner’s Dementia existed before first publically diagnosed in Feb. 2018, 6 months after retirement from the bench?

Because like Resident Biden and before him President Woodrow Wilson, his CIA handlers needed him to remain in his Manchurian Candidate position (a position he held for nearly 6 decades as a law Lecturer and 36 years as an appellate Judge!) to deconstruct and destroy the U.S. Constitution until they could no longer hide Posner’s increasing psychotic behavior. This I believe is why Judge Posner abruptly resign after 36 years with only one day’s notice…  

 

“Posner was diagnosed with Alzheimer’s disease [a form of Dementia] in early 2018 [Feb. 22, 2018], approximately six months after leaving the bench [Sept. 2017], and as of 2022 resides in a nursing facility.”^[86]

 

Third, Judge Posner’s 36 years on the federal bench (1981-2017) betrayed America, his country, our Republic that the Constitutional Framers bled and died to establish with Declaration of Independence (July 4, 1776), the U.S. Constitution, signed Sept. 17, 1787, ratified June 22, 1788, and the Bill of [Natural] Rights(the first 10 Amendments to the U.S. Constitution = the codification of Natural Law and Natural Rights into the foundation of the U.S. Constitution, Dec. 15, 1791). Even a cursory review of Posner’s Wikipedia biography demonstrates his fanatical zeal and Judas-like betrayal of virtually all constitutional principles put in place by America’s Constitutional Framers and the Founders of America’s Republic. See generally, David Barton, ORIGINAL INTENT: The Courts, the Constitution and Religion (1996). 

 

Finally, although Posner has been long-credited as the de facto “10th Justice on the Supreme Court,” due to his prolific oeuvre {collected works} and his national, legendary influence on all aspects of American law, and as one of the “World’s leading Public Intellectuals”). Posner’s entire education, academic and judicial career is entirely a CIA MK Ultra Mind Control CONSTRUCT. Everything he has written or spoken must be stricken from the public record because it is all SOLIPSISM and SOCIALISM, LIES and TREASON.

In my opinion, if Judge Posner had Christian (not Pagan or Regressive-Progressive) morality, humility, judicial discretion, and a proper understanding of American Jurisprudence that being a Constitutionalist Judge = Follow the Natural Law and Natural Rights foundations of U.S. Constitutional Law even if they differ from your own personal policies, preferences and beliefs, (See, my 2005 Law Review Article on the Exclusionary Rule), Professor Richard Posner would have never in good conscience accepted the federal appointment from President Reagan knowing in his mind and in his heart that from the beginning Judge Posner was a FAKE Conservative Constitutionalist, therefore a fake, dissembling Judge. 

 

But it is important to understand that from the beginning Judge Posner was trained at the CIA-Mossad MK Ultra Mind Control school called Harvard University and Harvard Law School to pave the way of his “career” as a fake Judge (and a fake academic). He was at best a prolific wordsmith and a propagandistic rhetorician… nothing more! In light of the QAnon movement (first post = 30 Oct. 2017), more and more people are revisiting and reexamining all of these so called “Great people” or “Elites” We the People have put before U.S. (The Bushes, The Obamas, The Clintons, all of the POTUS and Congressmen, CEOs, Tech Titans, Academics, Media Moguls, SCOTUS, etc. since 1870 and discovering that they did not obtain their lofty positions through assiduous work and merit but were essentially “Plants” , “Spies”, “Manchurian Candidates with this singular mandate = To Deconstruct, Destroy and Democide the U.S. Constitution, Culture, Society and all of America’s Institutions by “Invasion through Infiltration.”

 

At this point in my essay, here it seems rather pointless to go much deeper into Posner’s litany of Regressive-Progressive pontifications, paganisms and judicial treachery that Judge Posner he and other Socialist and Marxist, Liberal and Progressive academics call “Jurisprudence”. Below are just info taken from Judge Posner’s Wikipedia page detailing his litany of deception, arrogance and betrayal to We the People and to America our sacred Republic of which he took a solemn Judicial oath to uphold —

 

The Constitutional Oath The Judicial Oath The origin of the second oath is found in the Judiciary Act of 1789, which reads “the justices of the Supreme Court, and the district judges, before they proceed to execute the duties of their respective offices” to take a second oath or affirmation. From 1789 to 1990, the original text used for this oath (1 Stat. 76 § 8) was:   “I, _________, do solemnly swear or affirm that I will administer justice without respect to persons, and do equal right to the poor and to the rich, and that I will faithfully and impartially discharge and perform all the duties incumbent upon me as _________, according to the best of my abilities and understanding, agreeably to the constitution and laws of the United States. So, help me God.” In December 1990, the Judicial Improvements Act of 1990 replaced the phrase “according to the best of my abilities and understanding, agreeably to the Constitution” with “under the Constitution.” The revised Judicial Oath, found at 28 U. C. § 453, reads: “I, _________, do solemnly swear (or affirm) that I will administer justice without respect to persons, and do equal right to the poor and to the rich, and that I will faithfully and impartially discharge and perform all the duties incumbent upon me as _________ under the Constitution and laws of the United States. So help me God.” The Combined Oath Upon occasion, appointees to the Supreme Court have taken a combined version of the two oaths, which reads: >  “I, _________, do solemnly swear (or affirm) that I will administer justice without respect to persons, and do equal right to the poor and to the rich, and that I will faithfully and impartially discharge and perform all the duties incumbent upon me as _________ under the Constitution and laws of the United States; and that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.”

Keep in Mind–Judge Richard A. Posner is #1 among the most-cited legal scholars of all time by both legal journals and by the Supreme Court. Nevertheless, how could he outwardly hate the U.S. Constitution and it’s Natural Law and Natural Rights History for nearly 60 Years of his judicial and academic career as to make this hateful, demented statement about the Constitution in a Slate.com interview 1 year before being forced to resign from the bench when his dementia diagnosis could no long be hid from We the People?

 

What about all Laws of Congress, Executive Orders, and Judicial Decrees that contradict, are treasonous to, or “repugnant the U.S. Constitution”?
