The Seventh Amendment of the Constitution of the United States was ratified in 1791 as part of the Bill of Rights; it formally established the rules governing civil trials. The amendment’s objective was to preserve a distinction between the responsibilities of the courts (such as deciding matters of law) and those of juries (such as deciding matters of fact). While most people don’t know and cloistered academics, progressive politicians, bumbling bureaucrats and activist judges don’t care, there is little doubt that historically the Constitution’s framers took definitive steps to ensure that the federal government would not intrude into state issues through the 10th Amendment to the Constitution, which reads: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people. These are the 21 simple yet transcendent words of the Ninth Amendment. This country would not exist as we know it if the Bill of Rights and in particular the crucial Ninth and Tenth Amendments weren’t also included to protect federalism – states’ sovereign rights over federal socialist tyranny.
If we sometimes forget that under those black minister robes lie corrupt and corruptible men and women of flesh and blood, then Thursday’s ruling by SCOTUS should have been a sobering wake-up call for all Americans who love and revere the U.S. Constitution. Rush Limbaugh, citing a Politico editorial two days before called “Justice Roberts big moment,”pulled back the veil to reveal the real intent of what was at stake:
Like the proverbial hydra of Greek mythology, the deadly multi-tentacles of what I’ve termed the “Progressive Revolution” have so reached, affected and deconstructed every aspect of truth, law, politics, economics, culture and society that today it is nearly impossible to deduce what our Founding Fathers actually envisioned the laws of the country to be. Over the past 100 years, Congress, the president and the courts have so expanded federal power as to make states rights a dead letter.
Did you know that 93 years ago the Supreme Court decreed that advertising to your fellow Americans about their constitutional rights to be a federal crime? Astoundingly, this was the unanimous 9-0 decision of the case Schenck v. United States (1919). This case, in an openly fascist manner, violated defendant Schenck’s First Amendment rights to distribute flyers alerting his fellow citizens of their First, 10th and 13th Amendment rights not to comply with the draft and fight in World War I.
There are three things I hold as relative certainties in this uncertain, vexatious world of moral relativism: 1) God is in control of everything and every person in the universe and will one day settle all accounts, 2) the sun will rise tomorrow morning and 3) Justice Clarence Thomas will uphold his sacred oath he made 21 years ago “to protect and defend the Constitution against all enemies foreign and domestic.”
